Acceptance of Terms
By accessing or using the Repair Em website, portal, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
These Terms constitute a legally binding agreement between you (or the organization you represent) and Repair Em, Inc. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Description of Services
Repair Em provides IT asset disposition services including but not limited to:
Device Buyback
We purchase used IT equipment at competitive market rates
Trade-In Programs
Apply device value toward new equipment purchases
Data Destruction
NIST 800-88 compliant data sanitization services
Logistics
Pickup, packaging, and shipping coordination
Device Submission Terms
Important Ownership Requirement
You must have legal ownership or authorization to sell all devices submitted to Repair Em. Submitting stolen or unauthorized equipment is prohibited and may result in legal action.
Accurate Description: You agree to provide accurate information about device condition, specifications, and functionality. Quotes are based on the information you provide.
Quote Validity: Quoted prices are valid for 14 days from the date of quote. Prices may be adjusted upon physical inspection if device condition differs from description.
Data Removal: While we perform data destruction services, you are responsible for backing up any data you wish to keep before submitting devices.
MDM & Activation Locks: All devices must be removed from Mobile Device Management (MDM) and have activation locks disabled before shipment.
Payment Terms
Once devices are received, inspected, and verified, payment is processed within 30 days via your chosen payment method.
- Payment Methods: ACH transfer, check, or account credit (for trade-ins)
- Minimum Threshold: Minimum payout is $50. Smaller amounts may be held as credit.
- Taxes: You are responsible for any applicable taxes on payments received.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, REPAIR EM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID TO YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
WE ARE NOT RESPONSIBLE FOR DATA LOSS ON SUBMITTED DEVICES. ALWAYS BACKUP YOUR DATA BEFORE SUBMISSION.
Warranty Disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
Arbitration: Any disputes arising from these Terms shall be resolved through binding arbitration in San Bernardino County, California, in accordance with the rules of the American Arbitration Association.
Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
